PRIVACY POLICY AND PRACTICES
Informational Notice
Congress enacted the Financial Services Modernization Act (also
knows as Gramm-Leach-Bliley, or PL 106-102) that brought
significant changes to the way banks and financial services companies
maintain and disseminate information they gather with respect
to their clients. Part of the Act requires financial service providers,
including those who provide tax-planning services, to describe
to their clients how personal information about them is collected,
disclosed, and maintained.
In the course of facilitating 1031 exchanges, we have always been
committed to protecting the privacy of the information our clients
entrust to us. We are subject to rules of professional conduct,
as well as, provisions of the Internal Revenue Code, which requires
client information to be kept strictly confidential. While we
do not believe that Gramm-Leach-Bliley has altered our responsibility
to maintain the confidentiality of our clients personal
information, the Act requires us to provide our clients with this
notice regarding our privacy policy and practices.
Collection of Information
In the normal course of providing our clients with 1031 exchange
services, we may collect nonpublic personal information about
you from the following sources:
- Information we receive from directly from our client, such
as social security numbers and/or tax identification numbers;
and
- Information we receive from others involved in the 1031 exchange,
such as real estate agents, lenders, accountants, and attorneys;
and
- Information from the public records maintained by governmental
entities that we either obtain directly from those entities, or
from other third party sources, including information about the
clients transactions.
Disclosure of Information
- We do not disclose any nonpublic personal information
about our clients or former clients to anyone, except as permitted
by law or previously authorized in writing by the client.
- We require consent from a proper party to the transaction
to proved nonpublic personal information relating to their transaction,
which includes closed transactions.
- We allow clients to review their nonpublic personal information
that we have collected, and we allow them to provide us with requests
for amendment or deletion of such information, to which we will
reasonably respond.
Maintenance of Information: Confidentiality and Security
We restrict access to nonpublic personal information about our
clients to those employees who need to know the pertinent information
to provide services to the client.
We maintain physical, electronic, and procedural safeguards that
comply with federal regulations to guard our clients nonpublic
personal information and allow only authorized personnel to review
the information.
We keep all closed files in secure storage, with limited access,
or we store the files on computer with password protections.
